well I am apparently one of those John Does, how do I go about filing a motion to quash. From what I have researched I am lucky enough to catch this before it's to late and I can file a motion to quash the subpoena so my ex-ISP won't be required to give up my identification to the asshats who are trying to sue me for something I didn't even download.

Has anyone been through this bs before or have any advice?

I actually have no idea.. my wife had to sign for the subpeona(which didn't go over too well since it was for apparently downlloading "Real Female Orgasms 10" which, no, I did not download although now I am kicking myself in the ass for not securing my wi-fi =/)

I plan on filing a motion to quash because I know there is no way in hell I can settle for anything over $100 lol. Trying to figure out how to file the motion is a pain in the ass though... does anyone know how I would go about this?

somebody with legit legal advice might need to know the jurisdiction that it applies to. i'd just show up and tell them to pound sand.

yeah I got a telephone meeting with a Saper Law attorney tomorrow so we'll see how that goes... they filed to subpoena in missouri and I live in michigan so definitely out of jurisdiction.

not even sure that this doesn't qualify as some phishing scam. how you check to see if a subpeona is real?

it's not a subpoena from the plaintiff but from my ISP so they can give the plaintiff my information which is why I will be filing a motion to quash the subpoena before they can figure out who I am(for now atleast)

and actually I would have to show up in California for court ;)
