Also... normally I would use the whole 'ignorance is no excuse for breaking the rules/law/etc...' line, but some people do not really read the boards as often as some of us professional message board spammers. If you didn't honestly know about the War DNH (and you couldn't really determine that they knew or not from the amount of hits made) so the discretion would have to be between the person who hit and the person making the negotiation on the retals.
If you agree to doing too few hits, you may make the mistake of being too lenient, and they might do it again with another country in the string claiming the same thing, or claiming to be a member who didn't get the message for any variety of reasons (e.g.: no site, mediocre leadership with half-assed activity, playing time restrictions, etc...)
If you get them to agree to a maiming instead of killing the country, you run the risk of them disliking you for it, and possibly making an enemy. Or... in the case of a few incidents this set, a few well negotiated retals weren't wholly agreed to by both parties, or an overzealous member hits 'Send' one too many times, (e.g.: SAS, MasterC, etc...) or something other than what one would consider a standard retal (i.e.: Rockman, no offense) and situations like this have turned nasty.
It all boils down to how well you can negotiate and what you can get the one who's going to be taking the hits to agree to.
